1. Accepting these Terms

By downloading, installing, creating an account on or using the Service, you agree to these Terms and to our Privacy Policy, which explains how we handle your data. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Service. By using it, you confirm that you meet these requirements and that you are not prohibited from using the Service under the laws that apply to you.

3. Your account

• You can sign up with an email address and password or with Continue with Google. You must give accurate information and keep it up to date.
• You are responsible for keeping your login details confidential and for all activity under your account. Tell us promptly at hello@tripxcursion.com if you suspect unauthorised use.
• One person per account. You may not sell, transfer or share your account.
• You can delete your account at any time from Profile > Delete account or through our account deletion page.

4. What Tripxcursion does

Tripxcursion is a travel-planning tool. Features include an AI trip planner that generates day-by-day itineraries, Trip Reality Check for testing an itinerary against map, opening-hours, routing and weather data, travel mood suggestions for places near you, day maps and activity details, saved trips, and group trips with Blind Budget Match.

5. AI-generated content

• Itineraries, place descriptions, highlights, food suggestions, mood suggestions and budget estimates are created with the help of artificial intelligence (Google Gemini) and third-party data. AI output can be inaccurate, incomplete, out of date or unsuitable for your circumstances, even when it sounds confident.
• Budgets and costs shown in the Service are estimates, not quotes. Actual prices vary.
• Trip Reality Check verdicts are based on the data available at the time of the check. "Feasible" does not guarantee that a place will be open, a route will be clear or the weather will match the forecast. Items marked "unverified" could not be confirmed.
• You are responsible for reviewing all content and making your own decisions. Do not rely on the Service as your only source of information.
• You must not use AI features to create content that is unlawful, harmful, misleading or that infringes others' rights, and you must comply with the Google Generative AI Prohibited Use Policy.

6. Travel information and your safety

• Always check opening hours, entry rules, prices, tickets, transport schedules and closures directly with the venue or provider before you travel.
• You are responsible for your own travel documents, visas, permits, health requirements, insurance and compliance with local laws.
• Check official government travel advisories, weather warnings and local guidance. Some activities (for example treks, watersports, wildlife visits or travel in monsoon season) carry inherent risks. Only take part in activities that suit your health, fitness and experience, and follow the instructions of qualified operators.
• Distances and travel times are estimates. Follow road rules and do not use the app in a way that distracts you while driving.

7. Group trips

• An organiser can create a group trip, share an invite code, run the budget match, generate or remake the plan, reopen budgets or cancel the trip. Cancelling deletes everyone's private budget inputs for that trip.
• Members can submit, delete or change their own private budget and preferences, or leave the group.
• Individual budget amounts are not shown to other members or the organiser. However, a shared budget is calculated from everyone's inputs, so in very small groups or with very different budgets, members may be able to make inferences. Only enter what you are comfortable using.
• Only share invite codes with people you want in the group. Be respectful in display names and preferences you share with others.
• Tripxcursion does not collect money for, manage payments for, or settle costs between group members. Arrangements between members are their own responsibility.

8. Your content

• "Your content" means information you submit to the Service, such as trip details, itineraries you paste or upload, preferences and group display names. You keep ownership of your content.
• You give us a worldwide, non-exclusive, royalty-free licence to host, store, process, reproduce and transmit your content only as needed to operate, secure and improve the Service for you, including sending it to the service providers listed in our Privacy Policy. This licence ends when you delete the content or your account, except where we must keep it by law.
• You confirm that you have the right to submit your content and that it does not violate any law or anyone's rights. Do not upload documents containing other people's personal information without their permission, or sensitive information such as passport numbers or payment details.
• Itineraries generated for you may be similar to those generated for other users. We do not claim exclusive rights in generated itineraries, and you may use them for your personal travel.

9. Acceptable use

You agree not to:

• use the Service for any unlawful, fraudulent or harmful purpose, or to plan or facilitate illegal activity;
• harass, threaten, impersonate or abuse others, including in group trips;
• upload malware or content that is unlawful, defamatory, obscene or infringing;
• scrape, crawl, data-mine or systematically extract data, place information, photos or maps from the Service;
• reverse-engineer, decompile or attempt to access the source code, APIs or underlying models of the Service, except where the law allows it;
• interfere with, overload or bypass the security or usage limits of the Service;
• use automated means, bots or multiple accounts to access the Service or to submit waitlist entries;
• resell, sublicense or commercially exploit the Service or its content without our written permission;
• use the Service to build a competing product or to train AI models.

10. Third-party services

• The Service relies on third-party services, including Google Firebase, Google Sign-In, Google Gemini API, Google Maps Platform (Places API and Routes API), Mapbox and Open-Meteo. We are not responsible for third-party services, their availability or their content.
• Google Maps. Parts of the Service display Google Maps content. Your use of that content is subject to the Google Maps/Google Earth Additional Terms of Service and the Google Privacy Policy, which you agree to by using those features. Place data is credited "Google Maps" in the app.
• Mapbox. Maps and directions are provided by Mapbox under its terms of service, with map data from © Mapbox and © OpenStreetMap contributors.
• Links to third-party websites or apps are for convenience. Your use of them is at your own risk and on their terms.

11. Fees, subscriptions and purchases

The Service is currently free. We may introduce optional paid features, subscriptions or in-app purchases in future. If we do:

• The price, billing period and what is included will be shown clearly in the app before you buy.
• Purchases are processed by Apple (App Store) or Google (Google Play) under their terms. We do not receive your payment card details.
• Subscriptions renew automatically at the end of each period unless you cancel at least 24 hours before the end of the current period. You can manage or cancel in your App Store or Google Play account settings. Deleting the app or your Tripxcursion account does not cancel a subscription.
• If a free trial is offered, any unused portion ends when you purchase a subscription, where applicable.
• Refunds are handled by Apple or Google under their refund policies, subject to any rights you have under consumer law.
• Features that are free today will not become paid without notice, and we will not charge you for anything without your confirmation.

12. Advertising

The Service does not currently show ads. If we add ads in future, they will be provided by third-party ad networks as described in our Privacy Policy, and we will ask for any consent required by law. We are not responsible for the products or services advertised by third parties.

13. Our intellectual property

The Service, including its software, design, text, graphics, logos and the Tripxcursion name, is owned by us or our licensors and protected by intellectual property laws. Subject to these Terms, we grant you a limited, personal, revocable, non-exclusive, non-transferable licence to download and use the app on devices you own or control, for your personal, non-commercial use. All rights not expressly granted are reserved.

14. Feedback

If you send us suggestions or feedback, we may use them without any obligation to you.

15. Suspension, termination and deletion

• You may stop using the Service and delete your account at any time.
• We may suspend or terminate your access if you breach these Terms, if required by law, or to protect users, third parties or the Service. Where reasonable, we will tell you why and give you a chance to respond.
• When your account is deleted, your data is deleted as described in our Privacy Policy. If you organise a group trip, deleting your account cancels that trip for all members.
• Sections that by their nature should survive termination (including 8, 13, 17, 18, 19 and 20) will survive.

16. Changes to the Service and these Terms

We are constantly improving Tripxcursion and may add, change or remove features, or apply usage limits to keep costs fair (for example on AI generations). We may update these Terms from time to time. We will change the "Last updated" date above and, for material changes, notify you in the app or by email before they take effect. If you keep using the Service after changes take effect, you accept the updated Terms. If you do not agree, stop using the Service and delete your account.

17. Disclaimers

To the fullest extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, availability and non-infringement. We do not warrant that the Service will be uninterrupted, error-free or secure, or that any itinerary, verdict, suggestion, opening hours, travel time, weather forecast or cost estimate will be accurate or complete. Nothing in these Terms limits rights you have under consumer protection laws that cannot be excluded.

18. Limitation of liability

To the fullest extent permitted by law:

• we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for loss of profits, data, bookings, travel costs, missed connections, or for injury, loss or damage arising from travel or activities you choose to undertake based on the Service;
• our total liability to you for all claims relating to the Service will not exceed the greater of (a) the amount you paid us for the Service in the 12 months before the claim, or (b) INR 5,000 (or the equivalent in your local currency).

Nothing in these Terms excludes or limits liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot be excluded or limited under applicable law.

19. Indemnity

To the extent permitted by law, you agree to indemnify us against claims, losses and expenses (including reasonable legal fees) arising from your breach of these Terms, your content, or your misuse of the Service.

20. Governing law and disputes

These Terms are governed by the laws of India. Before starting any formal proceedings, please contact us at hello@tripxcursion.com so we can try to resolve the issue informally. Subject to the next sentence, the courts of India will have exclusive jurisdiction. If you are a consumer living in the European Economic Area, the United Kingdom or another country whose laws give you the right to bring claims in your home courts or under your local mandatory laws, nothing in these Terms takes those rights away.

21. Additional terms for Apple users

If you downloaded the app from the Apple App Store, the following also applies:

• These Terms are between you and us only, not Apple. We, not Apple, are solely responsible for the app and its content.
• Your licence to use the app is limited to use on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that the app may be accessed by other accounts associated with you via Family Sharing or volume purchasing.
• Apple has no obligation to provide any maintenance or support for the app.
• If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund any purchase price paid for the app (if any). To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.
• We, not Apple, are responsible for addressing any claims by you or a third party relating to the app, including product liability claims, claims that the app fails to conform to legal or regulatory requirements, and claims under consumer protection, privacy or similar laws.
• If a third party claims the app or your use of it infringes their intellectual property rights, we, not Apple, are responsible for the investigation, defence, settlement and discharge of that claim.
• You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and, once you accept them, Apple has the right to enforce these Terms against you as a third-party beneficiary.
• Questions, complaints or claims about the app should be sent to us using the details in section 24.

22. Additional terms for Google Play users

If you downloaded the app from Google Play, your use is also subject to the Google Play Terms of Service. Google is not a party to these Terms and is not responsible for the app. Any in-app purchases are processed under the Google Play Terms of Service and Google Play's refund policies.

23. General

• These Terms, together with the Privacy Policy, are the entire agreement between you and us about the Service.
• If any part of these Terms is found unenforceable, the rest remains in effect.
• Our failure to enforce a right is not a waiver of it.
• You may not transfer your rights under these Terms. We may transfer ours as part of a merger, acquisition or sale of assets, with notice to you.
• We are not responsible for delays or failures caused by events outside our reasonable control.
